BAHIS Interoperability Legislation Debate
Debate Topic 1:
This debate focuses on the Personal Information and Data Protection Tribunal Act (PIDPTA) and its role in enforcing Artificial Intelligence and Data Act (AIDA) rules through its proposed tribunal. While the tribunal can levy massive fines, the intersection of technical code and clinical judgment in AI often leads to malfunctions rather than simple data leaks.
The Question: Does a generalist government tribunal possess the necessary expertise to judge these "high-impact" health system failures, or is a US-style model of sector-specific oversight safer for patients?
Debate Topic 2:
The debate revolves around the recently proposed Bill S-5, which seeks to enforce secure information sharing across the Canadian healthcare system. This legislation introduces a "duty of data exchange" to improve interoperability and care coordination.
The Question: Should the duty of data exchange rest with the healthcare provider as a clinical obligation, or should it be framed as an individual patient’s right to data portability?
